Trump Signs Bill That Imposes New Restrictions On Online Vape Shops

President Trump has signed the 2021 omnibus spending bill that and while that is good news for many Americans who are in need of economic, it also means new regulations imposed on online retailers of vaping products.

The recently signed bill prevents online vape shops from mailing vaping products to customers using the United States Postal Service.

The bill effectively bans online vape stores from using the U.S. Postal Service (USPS) to ship vaping products to customers regardless of whether or not the products contain nicotine. Retailers of herbal vaporizers are also impacted.

As a result, online vape shops must now use private shipping services that collect the signature of an adult at the point of delivery.

Other requirements for online vape retailers include:

  • Registering with the U.S. Attorney General
  • Verifying the age of customers through the use of a commercially available database
  • Registering with the federal government and the tobacco tax administrators of states in which products are sold if those states impose a tax on vaping products
  • Collecting applicable local and state taxes
  • Affixing required tax stamps to products sold
  • Sending a list of all transactions for customers in states with vape taxes to state tax administrators for those states, which must include the names and addresses of the customers that the products were sold to as well as the types and quantities of the products sold
  • Records must be maintained for five years of any deliveries that are interrupted because the carrier determines or has reason to believe that the individual who placed the order is in violation of the PACT Act

The PACT Act is short for the Prevent All Cigarette Trafficking Act, which online vape retailers must now comply with in light of the recently signed bill.

Now that vape retailers and manufacturers who ship directly to customers can no longer use USPS to deliver their products, private shipping companies must now handle all vaping product shipments to consumers in the United States.

FedEx indicated in an announcement that it will no longer ship vaping products beginning later this year.
