The U.S. Food and Drug Administration (FDA) has the power to regulate the vaping industry, a power that the administration has already begun to exercise. In order to help prevent a virtual ban on the industry and its products, the Stop the Vape Ban coalition has kicked into gear and launched a new campaign in support of a piece of bipartisan legislation known as the FDA Deeming Authority Clarification Act of 2017 (H.R. 1136) that was introduced by Republican Congressman Tom Cole, who represents the state of Oklahoma’s 4th congressional district, and Congressman Sanford Bishop, a Democrat representing Georgia’s 2nd congressional district.

According to the coalition, recent FDA regulations “will result in a virtual ban on vaping products.” Subsequently, they’ve launched a new campaign with the goal of increasing awareness of the FDA’s new regulations and what they claim to be their eventual results: the closure of thousands of small businesses and the eradication of the rights of adult consumers to choose to vaporize.

“If left unchecked, the existing regulations will take away adult consumers’ right to choose to Vape and close thousands of small businesses.”

Explaining the coalition’s stance, the coalition’s senior vice present of government relations, Lyle Beckwith, explained in a statement that the coalition supports “sensible regulations,” or to be more specific: the regulations proposed by the aforementioned U.S. Representatives under H.R. 1136.

According to Cole, the bipartisan bill is designed to preserve the administration’s ability to regulate vaping products while grandfathering in currently available vape products that are already on the market. In addition, it would also require new vaping products to receive FDA approval before being introduced to the market.

“This legislation preserves the FDA’s ability to regulate these products on par with cigarettes, grandfathers currently available products and then requires the FDA’s approval before any new product is introduced.”

By Bishop’s account, the bill’s co-author, the proposed piece of legislation “would ensure the FDA’s regulatory process does not limit the availability of safer tobacco options for those seeking to make use of them.”

Members of the Stop the Vape Ban Coalition include the American Vaping Association, the Vapor Technology Association, the Smoke-Free Alternatives Trade Association, the American E-Liquid Manufacturing Standards Association, and the Electronic Vaping Coalition of America.
